Specific performance

If your real estate transaction falls apart, our firm brings an action to require specific performance of the contract. Specific performance is a form of relief that requires the party who breached or default on a real estate contract to fulfill the terms of the contract.

Specific performance is available to both sellers and buyers. A seller may seek specific performance if the buyer fails to meet the terms of the real estate contract. A buyer may seek specific performance under these circumstances:

  • If the seller is able to perform under the contract, but is unwilling to do so
  • if the seller cannot convey all of the property covered by the contract

Partition actions

Massachusetts real estate litigation sometimes is needed to resolve disagreements between co-owners of real estate. Oftentimes, co-owners agree to the division or partition of real estate.
